On 11/30/21, Tom Hals @ Reuters reported the Brandon administration has been stymied from enforcement of two mandates.
Brandon’s administration introduced new regulations in September 2021 to increase the U.S. adult vaccination rate. Red State Attorney Generals, trade organizations and conservative groups filed suits to stop the progressive loss of personal freedom for the nation’s workforce and halt the implementation of the new regulations.
Healthcare Workers
U.S. District Judge Terry Doughty, LA stopped CMS (Centers for Medicare & Medicaid Services) from enforcing a vaccine mandate for healthcare workers. Doughty’s ruling will be applied across the nation nationwide with the exception of ten states in which CMS has already been stopped from enforcing the rule due to a federal order in St. Louis. The “HERO” Judge stated that CMS lacks the authority to issue a mandate requiring greater than 2 million unvaccinated healthcare workers to get the injection. He stated further that mandating a vaccination for “10.3 million healthcare workers is something that should be done by Congress, not a government agency”.
Federal Contractors
There are a total of thirteen legal challenges across the country regarding the requirement that all Federal contractor employees be vaccinated with this being the first case ruling.
A U.S. District Judge in Frankfort, Kentucky blocked the Brandon administration from requiring all new government contractors in Kentucky, Ohio and Tennessee to place requirements on their employees requiring Covid injections.

Employers With 100 or More Employees
On November 8, 2021, a three-member panel of the 5th U.S. Circuit Court of Appeals in New Orleans upheld a ruling to put on hold Brandon’s vax requirement for companies. The most onerous regulation required vaccine or workplace testing but was temporarily blocked by a federal appeals court in early November.
The Fifth Circuit Court Judge Kurt Engelhardt wrote for the panel, “The public interest is also served by maintaining our constitutional structure and maintaining the liberty of individuals to make intensely personal decisions according to their own convictions – even, or perhaps particularly, when those decisions frustrate government officials,” Engelhardt wrote.
